Conditions of Sale
The sales conditions of Anthos apply to all agreements. The conditions of the contracting party are explicitly rejected, unless differently agreed in writing by both parties.
Orders
All offers are without obligation and while stock lasts. Orders must be confirmed in writing. If you wish to collect your order, it must be given to us at least five (5) days before the date on which you wish to collect it. The plants you ordered will then be ready for you at the agreed time. All orders, irrespective of the method of dispatch (collection or delivery), will only be supplied outside any periods of frost.
Authenticity of species
Although we endeavour to supply exactly the plants you ordered, it can happen that what is supplied appears not to be exactly what was ordered. Any communication about substitution should be in writing.
Plant Variety Rights
A number of plants in our catalogue are protected by plant variety rights (PVR). It is not allowed to propagate these plants without permission of the rightful claimant. We cannot be claimed responsible in case of illegal propagation by others. For more information, see https://cpvo.europa.eu.
Shipment
If you cannot collect your order yourself, it can be sent to you. This can be in by parcel post, but a courier service is used for larger orders.
Parcel post (NOT possible at the moment!)- Parcels are sent between 1 October and 15 April.
- Parcels are sent via PostNL www.postnl.nl at the applicable rates.
The following apply to parcel post:
- Postage and packing charges are a minimum of € 6,75 per parcel.
Dispatch by courier service
The charges vary according to weight and volume and will be passed on to you. There is no minimum order value. There are no packing charges apart from the charge for the packaging material itself.
Dispatch by haulier (abroad)
These orders must have a minimum size of at least one (1) euro pallet (1 x 1 x 2.1 m). The charges vary according to weight and volume and will be passed on to you. There is no minimum order value. There are no packing charges apart from the charge for the packaging material itself.
Payment
All prices are in Euro and are excluding VAT (9%) (Packaging costs are at the higher rate of 21%). Companies ordering from abroad are requested to quote their VAT registration number. The prices listed apply until a new catalogue is issued. We would advise you to pay cash or via wire transfer. We do not accept cheques. We regret that it is not possible to pay by credit card. Payment should be made within fourteen (14) days of the invoice date, unless otherwise stated. We will add 2% interest per month if this period is exceeded. Any collection charges will be at the purchaser’s expense.
Reclamation
We are trading with living products, which we can’t give any grow guaranty for. In case of reclamation we will ask you to document the defects (photographs/ description in writing). The reclamation has to find place immediately after receipt, respectively within a timescale which allows us to trace back the cause of the defect. We suppose the correct handling of the product (immediate planting after receiving, watering, fertilisation ETC.) is taken care of when the order has been received. We only replace the product itself in the same quality as how it was obtained, returning the plants value in Euro or a Credit note and not possibly occurring shipment costs. The replacement has to happen within the possible season for digging up and shipping the plants. Also the plant has to be available.
From January 2019 is the VAT increase from 6% to 9% valid.
