General Terms and Conditions
ABB - Tuinontwerp en Plantadvies Terms & Conditions
1. Definitions
Designer: ABB – Tuinontwerp en Plantadvies, providing design and advice services.
Client: The person or organization commissioning the work.
Assignment/Agreement: The project or services commissioned from ABB – Tuinontwerp en Plantadvies
2. Applicability
These terms apply to all quotations, assignments, and services, unless agreed otherwise.
3. Quotations & Confirmation
Quotations are valid for 14 days and non-binding.
Prices are in euros and exclude VAT.
Work starts after quotation approval and a 50% deposit.
Oral agreements are only binding if confirmed in writing.
4. Execution of Work
Work is carried out professionally and with care.
The designer relies on the accuracy of information provided by the client.
Any changes or incomplete information may result in extra charges.
5. Fees & Payment
Fees can be: percentage of project costs, hourly rates, or fixed amounts.
Additional work (e.g., design changes or legal requirements) is charged separately.
Invoices must be paid within 14 days. Late payments incur interest (8% per month for businesses, 3% for private clients).
Collection and legal costs are borne by the client.
6. Termination
Early termination by the client or due to client’s fault allows the designer to claim fees and expenses.
Termination must be in writing.
7. Delays
The designer is not liable for delays caused by third parties.
The client cannot claim compensation for delays.
8. Design Deviations
The designer has artistic freedom within the agreed concept.
Minor deviations that do not affect the usability of the design are not grounds for complaint or compensation.
9. Ownership & Copyright
All drawings, sketches, and documents remain the property of ABB – Tuinontwerp en Plantadvies
The client cannot copy or reproduce the design without permission.
Copyright transfer can be agreed separately with additional fees.
10. Liability
The designer is not liable for work by third-party experts.
Liability for damages is limited to the fee paid for the assignment.
Clients remain responsible for payments.
11. Force Majeure
Delays or non-performance due to circumstances beyond the designer’s control (e.g., strikes, supply issues, illness) are not the designer’s responsibility.
If force majeure lasts more than a month, either party may terminate the agreement without liability.
12. Governing Law & Disputes
Dutch law applies.
Disputes are submitted to the competent court in Boskoop, Netherlands, or another legally competent court at the designer’s discretion.
13. Plants Supplied
Plants are living products; no growth guarantee is provided.
Any complaints should be reported immediately, preferably with photos.
Plants will be replaced or credited at purchase value.
